All OBC certificates issued after 2010 in Bengal cancelled: High Court declared it illegal; 5 lakh people will be affected| Mamata Banarjee said- I don’t accept it

Culcutta High Court: The Calcutta High Court on Wednesday ordered the cancellation of all Other Backward Class (OBC) certificates issued in West Bengal after 2010. A bench of Justices Tapobrata Chakraborty and Rajasekhar Manthar said that since 2011, the administration has issued OBC certificates without following any rules.

The bench said- It is unconstitutional to issue OBC certificates in this manner. These certificates were issued without accepting any advice of the Backward Classes Commission. Therefore, all these certificates have been cancelled. However, this order will not apply to those who have already got a job or are about to get one.

Due to the cancellation of the OBC list, about 5 lakh certificates are going to be cancelled. The court directed that the West Bengal Backward Classes Commission will prepare a new list of OBCs on the basis of the West Bengal Backward Classes Commission Act 1993.

Mamata said – will not obey the order of the High Court

Regarding the decision of the High Court, Bengal CM Mamata Banerjee said that she will not obey the order of the High Court and BJP. OBC reservation will continue in the state. In a rally, Mamata said that just look at the courage of these people. This is a shameful chapter of our country.

Mamata said that many surveys were conducted before implementing OBC reservation. Many cases have been filed in this matter earlier, but they have not yielded any result. Why do these people not talk about the policies in BJP ruled states.

Mamata further said that PM Modi has been continuously talking about how minorities will take away the Tapashili reservation and this will destroy the Constitution. Minorities can never touch the Tapashili or tribal reservation, but the cunning people of BJP get their work done through agencies.

Amit Shah said- We will ensure that the court order is implemented

On this matter, Home Minister Amit Shah said that Mamata Banerjee gave OBC reservation to 118 Muslims without any survey. Someone went to court and the court took cognizance of the matter and cancelled all OBC certificates given between 2010 and 2024.

Mamata Banerjee wants to snatch the reservation of backward classes and give it to Muslims. I welcome the court’s decision. Mamata ji says that she will not accept the decision of the High Court. I want to ask the people of Bengal, can there be any such Chief Minister who says that the decision of the court will not be accepted. I strongly condemn this. We will ensure that the court’s decision is implemented.

Congress looted OBC reservation in Telangana and Karnataka. Now Mamata is doing the same thing in Bengal. These people want to snatch the reservation of backward castes, SC, ST and give it to minorities, especially Muslims. BJP opposes this.

The petition was filed in the High Court in 2011

PIL was filed in 2011 against the Mamata government’s decision to grant OBC reservation. It claimed that all OBC certificates issued after 2010 were issued bypassing the West Bengal Backward Classes Commission Act of 1993. The petition also said that people who were actually from the backward classes were not given their correct certificates.

In its order, the court said that the state government will have to submit the commission’s recommendation to the assembly as per the 1993 law. The OBC list will be prepared on this basis. Tapobrata Chakraborty’s bench said, ‘The assembly will decide who will be considered an OBC. Bengal Backward Class Welfare will have to prepare its list. The state government will present that list in the assembly. Only those whose names are in this list will be considered OBC.
